The Management Board of HELIO S.A. hereby announces that on 14.09.2009 the Company received the decision of the District Court for the City of Warsaw in Warsaw Faculty of Business XI – Pledge Register to register on 09.09.2009 teh registered pledge of PLN 7 500 000 for a set of stocks (other sets of things or rights which even the whole organization of its composition was variable) owned by the Issuer.

The registered pledge has been established to secure the claims of Fortis Bank Polska S.A. to HELIO S.A. under contract of credit on the current account in the amount of PLN 5 000 000. The value of the assets, which established above security in the accounting books of the Issuer as at 31.07.2009 amounted to PLN 9 955 180.39.

There is no relationship between the Issuer and the members of supervisory board or management board of the Issuer, and the entity on whose behalf was the establishment of the pledge. The fundamental criterion for recognizing the assets significant is exceedance of 10% of the Company’s revenues from sales in the last four quarters. Established lien exceeded the amount equivalent to EUR 1 000 000 converted by the average exchange rate announced by the Polish National Bank as at the day of establish the lien.
